The IKUNA Nature Resort is a company of the Biogena Group.
1. General Provisions
IKUNA Naturresort GmbH (hereinafter referred to as “IKUNA”) provides all services in its online ticket shop exclusively on the basis of these Terms and Conditions. Only persons aged 18 or older are permitted to make purchases in the IKUNA online ticket shop. These Terms and Conditions (“T&C”) apply to all services and bookings made via websites and webshop systems operated by IKUNA. By accessing the IKUNA website or using the applications provided—by any means—and/or completing a booking, the customer confirms to have read, understood, and accepted these T&C. All services purchased from IKUNA are non-transferable.
2. Scope of Application
These T&C apply to all current and future services provided by IKUNA in connection with the online purchase of tickets and access rights through web applications or other electronic media.
3. Subject Matter of the Contract
The contract concerns the electronic sale of access authorizations stored on data carriers (key cards) for IKUNA services. Not all services available at IKUNA can be booked online. The “Direct-to-Access® Ticket Reservation and Booking System” (DTA), developed by SKIDATA AG, handles the sale and activation of access rights (e.g., IKUNA tickets) for the SKIDATA access control system used by IKUNA, using electronic data carriers via the internet or other electronic media.
4. Special Conditions for Electronic Orders
4.1 Data Entry and Liability for Incorrect Information
Bookings can only be completed after full and correct entry of all required fields. Forgery of documents or intentional misrepresentation of personal details (e.g., birth year or eligible customer category) will result in immediate revocation of access rights and exclusion from services covered by the ticket. IKUNA reserves the right to pursue additional claims for damages. Reduced-price services (e.g., discounted tickets) must always be accompanied by proof of eligibility.
Customers must notify IKUNA of any changes to their communication data after booking—especially name or email address. Failure to do so makes the customer liable for any resulting damages and the customer cannot claim non-receipt of notifications sent to previously provided contact details. IKUNA is not entitled to withdraw from the contract solely because of the customer’s failure to update communication data.
4.2 Registration
Users may register or log in via social media accounts (Facebook or Google). Personal data can be updated at any time under “My Account”.
4.3 Conclusion of Contract
A successfully completed online booking constitutes a contractual offer by the customer. The customer acknowledges that once the “Buy” button is clicked, the offer cannot be canceled or reversed. After IKUNA verifies availability and payment details, the booking is confirmed via email. The contract becomes effective upon receipt of this confirmation. In the event of network failures, only data recorded in IKUNA’s cashier system are binding.
Before receiving the physical ticket (data carrier), the electronic booking confirmation serves as the sole valid proof of purchase. In the case of later complaints, the ticket and booking confirmation (printed or digital), or a photo ID must be presented.
If the customer does not use the purchased service for reasons attributable to their own responsibility, while IKUNA was ready to perform, the contract remains valid and the payment obligation remains. Statutory withdrawal rights remain unaffected (see Section 5). Complaints must be addressed exclusively to IKUNA.
A booking is incomplete or invalid if no email confirmation is received, if credit card payment fails or is canceled, or if payment is incorrect or incomplete. In these cases, provisional reservations will be canceled shortly thereafter. The IKUNA service hotline is available for booking issues, delivery problems, or other difficulties.
4.4 Payment
The webshop uses the Adyen payment system. Payment is made by credit card or other Adyen-supported methods. No third party has access to personal data or credit card numbers. Adyen uses SSL encryption to ensure secure data transfer. Season passes can only be booked with a current photo. All delivered goods remain IKUNA’s property until full payment is received.
4.5 Booking Processing
IKUNA uses various partners for the technical and financial processing of bookings, e.g., SKIDATA AG and Skiperformance AS. These companies do not enter into a contractual relationship with the customer unless one already exists for other reasons. During the booking process, users may be redirected to these partners’ websites; each company is responsible for its own content. The type and scope of booked services are also subject to IKUNA’s general park rules.
4.6 Tickets & Shipping
For season passes, shipping time must be taken into account (approx. 3–5 working days within Austria, 8–15 working days internationally). IKUNA accepts no liability for postal delivery times.
For family tickets, 5 individual tickets are sent to the buyer. They are valid for 2 adults and 3 children of the same family. Tickets must be redeemed on the same day; unused tickets become invalid without refund.
For discounted tickets, IKUNA may require proof of eligibility at the time of entry. If such proof is not provided, the ticket may be confiscated and entry refused without refund. Eligible discounts include (but are not limited to) regional family cards, corporate cooperation codes, and children’s rates (age verification may be requested). Only discounts explicitly listed by IKUNA are valid.
5. Withdrawal and Refund
IKUNA may cancel bookings at any time if the customer violates or attempts to circumvent contract terms. In the case of minor violations, IKUNA must first notify the customer once; cancellation is possible only upon repeated misconduct. Intentional misrepresentation is classified as a non-minor violation.
If IKUNA is operational and the relevant park areas are open, customers have no right to withdraw due to poor weather, early departure, temporary service interruptions, weather-related closures of specific areas, illness, or any other customer-related circumstance. No refunds will be granted and payment obligations remain.
Tickets cannot be redeemed outside park opening hours or beyond their validity period. In such cases, tickets become void, are not replaced, and cannot be redeemed later. Access rights are deleted at the end of the validity period.
6. Right of Withdrawal
If the customer is a consumer, they may withdraw from the online purchase within 14 days under § 11(1) FAGG, provided the purchase concerns season passes or tickets not tied to a specific date. The withdrawal period begins on the day the booking confirmation email is received.
Contracts for admission tickets related to leisure activities for a specific date or time period are not subject to the right of withdrawal. Therefore, no two-week withdrawal or return right applies to dated tickets.
Consequences of Withdrawal
If the customer withdraws, IKUNA will refund all payments received, including standard delivery charges (excluding additional charges for alternative delivery types chosen by the customer), without delay and no later than 14 days after receiving notice of withdrawal. Refunds are issued using the same payment method used for the initial transaction unless expressly agreed otherwise. No fees apply to the refund.
If the customer requested that services begin during the withdrawal period, they must pay IKUNA an appropriate portion corresponding to the services already provided up to the time the withdrawal notice was received.
7. Sample Withdrawal Form
Customers wishing to withdraw may use the following form and send it to:
IKUNA GmbH, Naturpfad 1, 4723 Natternbach, info@ikuna.at
“I hereby withdraw from the contract I concluded for the purchase of the following goods() / provision of the following services():
• Order number
• Date of receipt of booking confirmation
• Date of withdrawal
• Customer name and address”
8. Liability / Damages
Ticket malfunctions must be reported immediately at the nearest cashier. Later complaints regarding function or billing cannot be considered. Lost or forgotten tickets will not be replaced. Compensation for defective data carriers is excluded if the customer receives a replacement access authorization within a reasonable time at the cashier.
9. Data Protection (GDPR)
IKUNA processes personal data of employees, partners, customers, and suppliers for business operations and to meet contractual and legal obligations. The detailed privacy policy can be found at: INSERT LINK.
10. Applicability of IKUNA T&C, Severability Clause
In addition to these T&C, the general terms of IKUNA also apply to ticket purchases via the online shop and all related services. If any provision of these T&C is deemed invalid, the remainder of the contract remains unaffected.
